TERMS OF USE

Please review the following terms concerning the use of the Website (hereinafter the "Terms"). By using the Website, you agree to these terms and the privacy policy, which are provided “as is”. Ιf you do not agree, you may not use the Website. Αs long as you (hereinafter the “user”) comply with these terms, CENSUS S.A. (hereinafter “CENSUS”) grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Website.

USE OF MATERIALS

All materials provided on the Website, including but not limited to information, documents, software, images, logos, text, graphics, sounds, and all other content of any description available on the Website or included in any services we offer (hereinafter the "Materials"), are provided either by CENSUS or by its developers and associates and are the copyrighted work of CENSUS. Except as stated herein, none of the Materials may be distributed, republished, copied, reproduced, downloaded, displayed, posted or transmitted in any form or by any means, including but not limited to electronic, mechanical, photocopying, recording or other means, without the prior express written consent of CENSUS, as applicable. CENSUS does not sell, license, or lease any of the Materials.

CENSUS hereby grants to the user permission to display, copy, distribute and download Materials of CENSUS on the Website provided that:

  1. both the copyright notice and this permission notice appear in the Materials;
  2. the use of such Materials is solely for personal, non-commercial and informational use, and such Materials will not be copied or posted on any networked computer, broadcast in any media, or used for commercial purpose and
  3. the Materials are not modified in any way.

Materials of CENSUS include, among others, papers and information providing descriptions of services and fields of research carried out by CENSUS and are posted on the Website. CENSUS grants to the user the permission to post the unmodified Materials on his Website, provided that:

  1. the appropriate copyright notice is included with each of the Materials,
  2. the use of the Materials is for non- commercial and informational use only,
  3. the user properly attributes the Materials to CENSUS and provides a link back to the Website,
  4. nothing on the user’s Website reflects negatively on CENSUS, and
  5. the user agrees that CENSUS may withdraw this permission at any time for any reason.

Any permission described in these Terms terminates automatically without notice if the user breaches any of these Terms. Upon termination, the user will immediately destroy any downloaded or printed Materials.

Except where expressly provided otherwise by CENSUS, nothing on the Website shall be construed to confer any license for any rights of intellectual property of CENSUS. The user acknowledges the sole responsibility for obtaining any such licenses. Any unauthorized use of any Materials contained on the Website may violate intellectual property laws, the laws of privacy and publicity or other applicable laws and may raise claims from damages in favour of CENSUS.

ACCOUNT IN THE BLOG OF CENSUS

If user uses the authenticated features of the Website (content management functionality), user is responsible for maintaining the confidentiality of his account and password and for restricting access to his computer. User agrees to accept responsibility for all activities that occur under his account or password. CENSUS reserves the right to refuse service, terminate accounts, remove or edit content, at its sole discretion. All information published in the blog (blogpost) shall construe to be intellectual property of CENSUS. Of course, in case a reference is made to copyrighted material of third parties, the post on the blog shall mention the source therefrom and publication shall take place, after prior written consent of such third parties.

CENSUS reserves the right to suspend user’s access to the Website for scheduled or emergency maintenance, if the user publishes defaming comments in relation to CENSUS or in case user proceeds to actions violating applicable laws, rules or regulations.

ELECTRONIC COMMUNICATIONS

When a user visits the Website or sends e-mails to CENSUS, he is communicating with CENSUS electronically. The user consents to receive communications from CENSUS either electronically or by any other means deemed appropriate by CENSUS, upon user’s request for any information.

INTELLECTUAL PROPERTY RIGHTS AND INFRINGEMENT

Under the present Terms, Intellectual Property Rights are considered to be all patents, registered designs, unregistered designs, design rights, utility models, database rights, copyright and other similar statutory rights, trade mark, service mark and any know how relating to algorithms, drawings, tests, reports and procedures, models, manuals, methods, processes or any other intellectual or industrial property rights of whatever nature in each case in any part of the world and whether or not registered or registerable, for the full period and all extensions and renewals where applicable. The intellectual property rights entailed in the Website are protected by intellectual property laws and may not be copied or imitated in whole or in part. User is prohibited from sharing, renting, leasing, lending, reselling, sublicensing, distributing, using or otherwise transferring the intellectual property rights of CENSUS for any purpose. None of the intellectual property rights from the Website may be copied or retransmitted unless permitted in writing by CENSUS.

All other product names, company names, marks, logos, and symbols may be the trademarks of their respective owners.

All title, ownership rights and world-wide intellectual property rights (including all patents, copyright, trademarks, trade secrets and moral rights) in and to any scripts, software, documentation, materials, methodologies, knowhow or other such information or materials that are developed or provided by CENSUS in the course of delivering the Services is and will remain the exclusive property of CENSUS.

CENSUS is entitled to commence any legal proceedings in case of infringement of its intellectual property rights, as set forth in the applicable legal provisions. Any delay or non-commencement of such proceedings shall not construe to be waiver from said rights.

RESTRICTIONS

The user may not collect any articles for commercial use. The user may not reproduce or copy the Website or any portion of the Website for any commercial purpose without express written consent of CENSUS. The user may not download or copy information for the benefit of another undertaking.

The user may not make use of data mining, robots, or similar data gathering and extraction tools or engage in "deep-linking" on the Website. The user may not use any meta-tags or any other "hidden text" utilising the name or trademarks of CENSUS without the express written consent of CENSUS. The user may not utilise framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of CENSUS without express written consent οf CENSUS. The user may not probe, scan or test the vulnerability of the Website or any network connected to the Website, nor breach security or authentication measures used on the Website or any network connected to the Website.

LINKS TO THIRD PARTY SITES

The Website may contain links to websites controlled by parties other than CENSUS. CENSUS is not responsible for and does not endorse or accept any responsibility for the contents or use of these third party websites. CENSUS is providing these links to the user only as a convenience, and the inclusion of any link does not imply endorsement by CENSUS of the linked website. It is on the user’s own responsibility to take precautions to ensure that whatever materials the user copies or downloads from third party websites are free of viruses or other items of a destructive nature or malware software.

CENSUS is not liable for any damage or loss caused or alleged to be caused by or in connection with enablement, access or use of any such third party websites. CENSUS can by no means be held liable, if any computer code or other computer instructions, devices or techniques, including without limitation those known as viruses, disabling devices, Trojans that intentionally disrupt, infect, defraud, harm, damage or otherwise impede in any manner, the operation of a network, computer program or computer system or any component thereof, including its security or user data.

COOKIES

CENSUS may use cookies to improve and facilitate use. Cookies are files created by CENSUS or other sources, such as ads or images, embedded on the site in order to collect personal preferences and technical information in the user’s computer and they do not contain or reveal personal information. CENSUS uses cookies for statistical reasons in connection with Google Analytics and for security reasons related to the Website's operation. No information deriving from cookies is stored on the server of CENSUS.

If the user does not accept any use of cookies by the CENSUS website, he can change his browser settings not to accept cookies knowing that he may have limited or insecure access to some of the services, uses, functions and content provided by the website. Selective opt-out of third party cookies (Google Analytics) is possible through the cookie consent dialog.

LIMITATION OF LIABILITY

CENSUS shall not be liable for any damages suffered as a result of using, modifying, contributing, copying, distributing, or downloading the materials.

In no event shall CENSUS be liable for any direct or indirect, special, incidental, or consequential damage (including but not limited to loss of business, revenue, profits, use, data or other economic advantage), however it arises, whether in an action arising out of contract, negligence or other tortious or quasi-tortious action, arising out of or in connection with the use of the Website or of any materials contained on or made available through the website, even if CENSUS has been previously advised of the possibility of such damage.

The user bears sole responsibility for the adequate protection and backup of data and/or equipment used in connection with the website and the user will not make a claim against CENSUS for lost data, work delays or lost profits resulting from the use of the materials. The user agrees to hold CENSUS harmless from, and user covenants not to sue CENSUS for any claims based on or related to the use of the site or of any materials contained on or made available through the Website.

INDEMNIFICATION

The user will be fully responsible for compliance with the Terms and any breach of the Terms shall bring about claim of indemnification by CENSUS.

The user agrees to indemnify, compensate, defend and hold harmless CENSUS and its managers, managing partners, shareholders, agents, employees, licensors and service providers from and against any and all claims, losses, liabilities and expenses (including attorney's fees and other legal costs), whether arising out of contract, tort, quasi-tort or otherwise, relating to or arising out of the user’s breach of these Terms, applicable law or any right of CENSUS.

APPLICABLE LAW

CENSUS controls and operates the Website from its headquarters in Thessaloniki, Greece. If the user enters the Website from other locations, he is responsible for compliance with applicable local laws.

Any action related to these Terms will be governed by Greek law. No choice of law, rules of law and rules on conflict of laws will apply. The courts of Thessaloniki, Greece shall have exclusive jurisdiction to determine any disputes, which may arise out of, under, or in connection with these Terms.

These Terms represent the entire understanding relating to the use of the Website and prevail over any prior or contemporaneous, conflicting or additional, communications. CENSUS has the right to revise these Terms at any time without notice by updating this posting. Any subsequent use of the Website by the user will be governed by the revised Terms. Any rights not expressly granted herein are reserved by CENSUS. Headings are used in these Terms for reference purposes only and shall not be used to interpret or construe these Terms. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be deleted and the remaining provisions stay in full force and effect.

Updates to the Website Terms of Use will be communicated to users through an explicit consent dialog.
